    Is it appropriate to weigh and balance cross-market efficiencies and anticompetitive effects in platform markets? The Supreme Court in AmEx says it is appropriate to do so in monopolization cases involving financial platforms. Officials from both agencies suggested that the Amex decision, though, should be limited, and almost is sui generis

     

    Apart from per se cases where the law declines to assess effects because it is so unlikely the conduct in question will be beneficial, antitrust should never assign liability without a showing that the net social welfare effect of the challenged conduct is negative. In Philadelphia National Bank, the Supreme Court suggested that antitrust analysis always has to proceed market by market. Really? So if a joint venture leads to price increases of $10 in one market and price decreases of $1,000 in a second market, we should condemn the JV because of the effects in the first market? That would be crazy.

     

    Of course, to say that antitrust analysis should take into account net effects doesn't address who should bear the burden of proof as to what. It would make sense, for example, to hold that a plaintiff satisfies his or her burden of proof by showing net anticompetitive effects in one market or on one side of a two-sided market, but that the defendant may then rebut by showing effects in other markets or on other sides of the market. Am Ex seems to put the burden of proof on the plaintiff to show net effects on both sides of the market, and I'm undecided as to whether that's right. But I'm quite certain that the law shouldn't artificially close off inquiry into net effects.


    Everyone talks about network effects in platform markets, as if it were universally a characteristic of these industries. It seems to be that is not the case, and while some markets have direct network effects, some have indirect network effects, and some do not have network effects at all. What are your thoughts and how do you generally consider platform markets and such network effects? 

     

    I agree that there shouldn't be any formal legal presumption that any particular kind of industry--whether platform markets, or operating systems, or anything else--displays any particular kind of network effects. That should be a matter of proof on a case-by-case basis. And observe that it's not clear ex ante which side's case will be benefited by a finding that the market displays network effects. Here's a point I made about Microsoft in my article Market Power without Market Definition: If network effects are very strong, then that supports the argument that there are entry barriers into the operating system market, and hence that Microsoft has market power. But if the network effects are very, very strong, that also means that Microsoft doesn't need to engage in anticompetitive conduct to exclude rivals--the market is effectively a natural monopoly.

     

    Competing platforms can monetize and distribute in different ways. For example, Apple incorporates its iOS platform into its hardware and sells the bundle for a certain price. Google, on the other hand, freely licenses Android to handset OEMs, and monetizes through search and apps. The European Commission recently concluded that the difference in monetization meant that the products at issue were not in the same market. Thoughts?

     

    We can borrow a concept from tying law here: whether A and B are two products or one should really depend on whether customers want the option to buy them separately. Take personal computers. Every customer wants to buy a PC with an installed CPU. That means that PCs and CPUs are a single product for purposes of tying analysis. That some customers might care about which brand of CPU--Intel or AMD--is embedded in their PC doesn't change this analysis. PCs with CPUs are still a single product for purposes of antitrust analysis.
